    Good afternoon

    We explained in our last update that we were awaiting several key items from Mulalley to enable us to achieve practical completion.

    We have received some of the documents from Mulalley and also through commissioning our own inspections. There is one outstanding item required on the lift maintenance certification which Mulalley are rectifying. We are waiting confirmation from Mulalley that they have resolved this item. We are discussing partial possession with Mulalley because we are keen to take practical completion of block C and await their response.

    For block B, we had 48 outstanding items with Mulalley. Some of these items have now been received but some remain outstanding. We are identifying alternative options and will start to instruct their completion ourselves this week. Whilst we can’t put a timeframe on how quickly this information will become available, we will provide another update on progress next week.

    Our next update will be sent by 11 June 2025 but please do let us know if you have any queries.

    We have had some queries around the offers we have made to cover some of the costs incurred due to the delay, we will add a breakdown on Engagement HQ.

    Good afternoon,

    As mentioned in our last update, we have received some of the required certifications for taking practical completion, but several key items remain outstanding. Specifically, we are still waiting on documentation for AOV's smoke ventilation, height safety equipment (which includes man-safe systems and free-standing handrail systems), fire alarm system certification, and lift maintenance certification. Some of these certifications are critical as their expiry dates are approaching, and they must be renewed before we can proceed with practical completion.

    Since Mulalley has yet to supply this documentation or provide a timeline for its delivery, we have decided to commission contractors ourselves for Block C's documentation. We have notified Mulalley of this decision and are in the process of scheduling these inspections, which we expect to take place within the next week.

    In addition, there are outstanding items for Block B that we need to address in order to register the building with the building safety regulator. We have reviewed and commented on the drawings, which are now back with Mulalley for their review. We are also compiling a list of items missing from the O&M manual, which we will send to Mulalley tomorrow. We will give them a two-week deadline to provide the missing information. If the documentation is not received by this deadline, we will need to consider whether we can commission contractors to obtain this documentation ourselves.

    We are still aiming to take partial possession of Block C, with Block B to follow once we have received the necessary documents to submit the application to the building safety regulator.

    Last week, we informed you that further certification was required, and our aim was to give you a clearer timeline this week.

    Progressing to PC

    To achieve practical completion, the following compliance items remain outstanding. Most of these are because the initial commissioning period has lapsed due to the overall delay. Mulalley is responsible for providing this information to enable us to achieve PC:

    Pumps – heating

    Inhibitors for block C

    Cold water cat5 pumps

    AOV’s smoke ventilation

    Warden Call system for block B

    Communal fire doors

    Height safety equipment including man safe, free-standing handrail systems.

    We also need to ensure that Mulalley have been carrying out regular inspections and we have requested the evidence of this. For example, CCTV, powered doors and gates, lighting protection.

    We had advised that there was a risk of accepting PC for block B whilst there was also additional documentation required for the registration. To mitigate this, we have been discussing whether Mulalley would allow us to work on a strategy for achieving sectional completion. Previously we have been unable to get their agreement, but they have now verbally agreed which enables us to take and occupy block C whilst getting the required comfort for block B. We are pushing forward with Mulalley to formalise this as soon as possible, and to obtain the required outstanding information.

    Timeline for occupation of block C

    The timeline to accepting PC is still dependent on the contractor's responsiveness in providing the commissioning certificates listed above. Mulalley has been asked to provide us with a timeline to identify when the outstanding items will be achieved. We have contacted Mulalley on several occasions for this and escalated the request to both Director and Managing Director level, but we have not yet received a timeline. Without it, we are unable to give you a specific timeline. Once we are in receipt of these, we will be able to set a date to take PC and serve notice to complete to those buying in block C and this would be a very quick process. Setting the PC date would usually take place within a week and notice to complete would usually be within 10 working days (subject to your finances and current living arrangements).

    PC for Block B

    Whilst we do not require the full suite of documents for the BSR to achieve PC, we do still want assurances that we can achieve what is required in the relevant formats, and will as a very minimum need the above documentation to achieve PC for block B. The collation of and review for the building registration is progressing, and 75% of the Operations and Maintenance manual has been completed. Once reviewed we will liaise with Mulalley to obtain missing or insufficient information and conduct subsequent reviews until all items are satisfactory. The duration of this process and a timeline is dependent on the contractor's responsiveness in amending and providing the documents. Mulalley has been asked for a timeline for these items as well and we are also awaiting a response for this.

    Should Mulalley fail to provide the required documents for building safety registration, we would need to commission inspections directly with alternative contractors, which can be achieved but would further extend the timeline for us to procure and instruct. We previously stated that occupation would be 8 weeks from achieving PC which we still believe to be the case, but at this stage we are unable to advise on a PC date for block B based on the above.

    Parking

    The Section 278 process is still underway, and a meeting was held with the local authority last week. We have reiterated that we are pushing forward to occupy block C, but they are not facilitating expedition of the approval we require to instruct the works. They have advised that it will be up to a further six weeks to provide us with an outcome. To date we have provided all of the information and answered any questions they have had about the plans. Once they approve the works it will take up to two weeks to instruct and complete, and up to two weeks for their full sign-off.

    Potential plot changes

    We have had some buyers approach us as to whether there is the possibility of plot swapping from block B to C. We do have two apartments available in block C, both with two bedrooms. If this is something you wanted to discuss further, please contact our sales team to discuss.

Over the period to our next update, our continued focus is on obtaining formal agreement from Mulalley to the sectional PC, a timeline, and the outstanding certificates to accept PC. Additionally, we will continue our review of the documentation for the registration of Block B.

    If there is sufficient information received on any of these three points before our next update, we will inform you between otherwise our next update will be on 21 May 2025.

    I hope this email finds you well. I am writing to address the ongoing concerns regarding the information we have been sending to update you on our progress towards PC. I want to deeply apologise for any confusion or frustration our updates may have caused you. Please know that I am actively working on resolving these issues to ensure that you receive accurate and reliable updates about our progress.

    To enhance the accuracy of the information we share, I have asked Richard White, my Executive Director, to take on the role of providing and confirming programme and documentation updates. I have been made aware that there are still some certificates that are required, which is because they have lapsed from their original production date. These relate to items such as the pumps, central plant, and water testing. There are also some items still outstanding in relation to the O&M manual. This is new information that has been shared with us, and so I am unable to give you any more information with this update, but with Richard’s oversight, we will have the correct details and timelines to share with you by next week's update.

    Despite this information coming to light, I can assure you that we are getting much closer to taking PC. Once we have taken PC, our best estimate for the timescale on Block B’s registration is as we have advised previously, at 8 weeks from PC. This is based on the information we have for submission, what we will need at PC, and the information we are currently working to obtain with Mulalley and our own management information. The 8 weeks is an indication, as the information will need to be reviewed, and we cannot guarantee it would be 8 weeks due to mitigating factors such as errors identified or third-party compliance within those timescales.

    Involving my Executive Director in this process will help us ensure the highest level of accuracy and reliability in the information my team shares with you. My team is dedicated to providing you with the most precise updates possible. We understand your frustrations with the previous updates and that you are looking for a clearer understanding of what we are waiting on for PC.     Thank you for your continued patience as we work to complete your new homes. We understand how frustrating the delays have been and are sincerely sorry for the inconvenience caused.

    The gas safety certificates have now been fully checked and verified. Our technical team is in the final stages of closing out the remaining requirements for Building Safety Registration, working closely with the construction team to ensure everything is in place.

    We want to reassure you that the ‘as built’ information is being carefully reviewed and confirmed to ensure full compliance with current building safety regulations.

    We will provide a further update on 23 April. However, if we are in a position to confirm practical completion before then, we will contact you straight away.

    We still haven’t received the outstanding gas certificates as we have mentioned previously, we are unable to take PC without these in place. Having been advised last week that these certificates would be issued, we have now determined that Mulalley do not have them yet from their sub-contractor and they anticipate being in receipt of them by Monday 7 April.

    Once we are in receipt of the gas certificates, we can begin to discuss potential practical completion dates with Mulalley. We still take the view that while the full suite of documentation for the high-rise buildings is not a prerequisite to taking PC, we also need to satisfy ourselves on matters such as fire safety before we take PC. This is because Mulalley is not contractually obligated to provide this support, which presents a potential risk.

    We will provide another update by Tuesday 8 April.

    Following our update on Wednesday, we had anticipated receiving the outstanding gas, emergency lighting, and dry riser certifications which would enable to be more specific about the timeline. We have received the emergency lighting and dry riser certificates, but the gas certificates are still outstanding. As these have not been provided, we are unable to progress to Practical Completion (PC) with Mulalley. These documents are critical conditions for PC; without them we are unable to proceed. We feel it important to continue to be transparent about the potential risks, that we must be satisfied the documentation is to the standard that our business and the regulator requires.

    While the full suite of documentation for the high-rise buildings is not a prerequisite to taking PC, we also need to satisfy ourselves on matters such as fire safety before we take PC. This means there are also considerations we need to take before progressing to PC. As advised in our Wednesday update, Mulalley is not contractually obligated to provide this support, which presents a potential risk. Should inaccuracies arise in drawings, certificates, or reports, such as incorrect addresses or misplaced elements, corrections would require Mulalley's assistance. Furthermore, we acknowledge buyer communications indicating Mulalley has no outstanding obligations to Southern Housing raising our concerns about their responsiveness to future requests. We will be visiting site on Tuesday and will update you on Wednesday if we have received the final certificates which means we can progress to PC.

    As soon as we receive these documents, we will be able to take PC of both blocks C and B. Once we take PC, we will serve notice to complete to those purchasing in block C. This will enable completions to commence. As mentioned on Wednesday, for those of you who have parking included then we will contact you separately about this.

    Block B will need to be registered, and we are finalising the information required. We have been working in the background and have collated a significant amount of the information. This process will continue as there are some gaps, and we need to review the documentation as it’s received and prepare our pack for submission to the regulator. We have given an estimation of being ready to submit to the regulator at 8 weeks, and this is based on what documentation we currently have.

    Good afternoon

    Further to our previous update, we are sending you the below summary or the outstanding items ahead of taking practical completion and for occupation of block C at Greenside.

    There are still actions outstanding from Mulalley. For block C these are:

    1. Certification – gas safety, emergency lighting and dry riser certification needs to be updated
    1. Heat Network - As previously advised, there was an issue with the commissioning of the heat network and how it relays usage data to the building management system. Mulalley have not been able to fully resolve this, however the heating and the hot water within the apartments is working satisfactorily. We are fully aware of how important it is for you to occupy your homes; we have therefore taken a view that we can resolve this matter once you are in occupation.
    1. Preoccupation FRA - There are some minor outstanding actions following the pre-occupation FRA, which relates to communal areas, this will not delay completion or affect individual apartments.
    1. Mulalley awaits highways department approval to the S278 plans. This issue will not be resolved prior to practical completion, and we will still be able to occupy. This will mean no access to the lower car park, and we will contact those affected separately.

    For Block B, the document controller completed their review of the drawings linked to the project and the actions are being collated to be returned to Mulalley. Whilst a significant amount of documentation has been reviewed, there are other major elements of the pack to be audited before we can submit for registration. We anticipate this will take a further 8 weeks from PC.

    Mulalley have no contractual requirement to supply the level of documentation we need to be able to submit for registration, this is because the development was contracted before the legislation came into force. We feel it important to be transparent about the potential risks and we must be satisfied that the documentation is to the standard that our business and the regulator requires.

    For taking PC and occupation of block C, we are 24 hours off having a clearer view on a timeline and so will provide you with this by Friday 28 March.
